These Terms of Use (“Terms”) are a legal agreement between you and Acarin LLC (“Cysterly,” “we,” “us,” “our”), the maker of the PCOS AI: Cysterly mobile application (the “App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. What Cysterly is — and isn't
Cysterly is a wellness and self-tracking app that helps people with PCOS log symptoms, food, cycle, lifestyle, and weight, and see patterns in their own data. It is intended for general wellness and informational purposes only.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) to purchase a subscription, and at least 13 (or 16 where required) to use the App. By using Cysterly you confirm you meet these requirements and that the information you provide is accurate.
3. Your license to use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service, for your own personal, non-commercial use. You may not copy, modify, reverse-engineer, decompile, rent, resell, or create derivative works from the App, except where such restrictions are prohibited by law.
4. Subscriptions, billing & auto-renewal
Cysterly is offered as an auto-renewable subscription. Current plans are a monthly plan and a yearly plan (for example, $7.99 per month and $49.99 per year in the United States; prices may vary by region and may change). The plan, length, and price are shown to you in the App before you purchase. By subscribing, you agree to the following:
- Payment is charged to your Apple ID account at confirmation of purchase.
- Auto-renewal: your subscription automatically renews for the same length and price unless you turn off auto-renew at least 24 hours before the end of the current period.
- Renewal charge: your account is charged for renewal within 24 hours prior to the end of the current period.
- Manage or cancel at any time in your Apple ID Account Settings after purchase. Deleting the App does not cancel your subscription.
- If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
All purchases are processed by Apple, and refunds are handled by Apple in accordance with the App Store terms and applicable law — we cannot directly issue App Store refunds. Apple's terms govern your purchase: see Apple Media Services Terms.
5. Acceptable use
You agree not to misuse the App. In particular, you will not: use it for any unlawful purpose; attempt to gain unauthorized access to our systems or the services we rely on; interfere with or disrupt the App; upload malicious code; or use the App in any way that infringes the rights of others. We may suspend or end your access if you violate these Terms.
6. Your data & privacy
Cysterly is private by design — your health logs are stored on your own device, and we do not collect or store them on our servers. A few optional features (such as AI meal recognition, AI pattern summaries, and weather) only send data when you choose to enable them. How we handle information is described in our Privacy Policy, which is incorporated into these Terms. Because your data lives on your device, you are responsible for backing it up (Settings → Export); we are not responsible for data lost when you change, reset, or lose your device, or delete the App.
7. Intellectual property
The App and its content, design, logos, text, graphics, and software are owned by Acarin LLC or its licensors and are protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or branding. The personal data and entries you create remain yours.
8. Third-party services
The App relies on third-party services for certain features (for example, Apple for distribution and payments, RevenueCat for verifying subscription status, and — only when you enable them — Anthropic for AI features and Open-Meteo for weather). Your use of those features may also be subject to those providers' terms. We are not responsible for third-party services we do not control.
9. Disclaimers
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any insight or estimate it produces is accurate or complete. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
10. Limitation of liability
To the fullest extent permitted by law, Acarin LLC and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of (or inability to use) the App. To the fullest extent permitted by law, our total liability for any claim relating to the App will not exceed the amount you paid for the App in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Indemnification
You agree to indemnify and hold harmless Acarin LLC from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the App or your violation of these Terms or of any law or the rights of a third party.
12. Changes to the App and these Terms
We may update, change, or discontinue features of the App at any time. We may also update these Terms from time to time; when we do, we will post the new version here and update the “Last updated” date. Your continued use of the App after changes take effect means you accept the updated Terms.
13. Termination
You may stop using the App at any time. We may suspend or terminate your access if you violate these Terms or if required by law. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
14. Governing law
These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules, except where applicable consumer-protection law provides otherwise. If any provision is found unenforceable, the rest of the Terms remain in effect.
15. Apple App Store terms
Because you obtain the App through Apple's App Store, the following also apply:
- These Terms are between you and Acarin LLC only, not with Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
- Acarin LLC, not Apple, is responsible for addressing any claims relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, consumer-protection claims, and intellectual-property claims.
- Acarin LLC, not Apple, is responsible for investigating and resolving any third-party claim that the App infringes intellectual-property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
